The Flexcar Referral Program (“The Program”) allows an existing customer (“Referrer”) the opportunity to earn promotional credits (“Referral Rewards”) by referring new customers (“Customer”) to become new users on Flexcar. Customer must sign up using the unique code provided to them by Referrer which will be generated by Flexcar when the Referrer elects to participate in the Program through the app. Referrer is prohibited from posting referral links or codes on any deal aggregator websites (such as RetailMeNot). Flexcar reserves the right to deactivate or invalidate any Referral Rewards obtained through these channels.
To participate, Referrer and Customer must agree to these terms, which become part of the Flexcar Terms of Service. Terms that are not defined here will have the same meaning given to them in the Flexcar Terms of Service.
How to Earn Referral Rewards
Referrers can earn Referral Rewards if: (i) a Customer enters the Referrer’s referral code to create a valid Flexcar account that complies with our Terms of Service; (ii) Customer is a new user (iii), the Customer books a Qualifying Reservation (as defined below) and (iv) successfully completes vehicle pickup.
The Referrer will be credited with the Referral Reward amount(s) specified in the referral invitation and/or accompanying promotional materials after the successful vehicle pickup by the Customer.
A “Qualifying Reservation”, as used herein, must be booked and paid for via the Flexcar platform, and the Customer must complete vehicle pickup before the Referrer can receive Referral Rewards. A reservation by a Customer will not be considered a Qualifying Reservation. No Referral Rewards will be earned, if the Customer does not complete vehicle pickup or the reservation is cancelled at any time for any reason.
Redeeming Referral Rewards
Referral Rewards may only be redeemed via the Flexcar Platform. Referral Rewards are automatically applied to the full mileage balance of the next available bill. Referral Rewards are issued for promotional purposes only; they have no cash value and may not be transferred or exchanged for cash or cash equivalents. Referral Rewards are not transferrable and may not be auctioned, traded, bartered, sold or assigned.
Referral Rewards may not be earned by creating multiple Flexcar Accounts. Referral Rewards accrued in separate Flexcar accounts may not be combined into one Flexcar account.
Referrer and Customer cannot be the same person.
If for any reason you believe that there is a discrepancy regarding your balance of Referral Rewards, please contact us. Flexcar may require you to submit additional information in order to make a determination regarding your balance. All decisions regarding your balance will be final and at Flexcar’s sole discretion.
Referrers and Customers are responsible for any Tax consequences, if any, that may result from redemption or use of Referral Rewards.
Sharing Referral Codes
Referrals may only be used for personal and non-commercial purposes. Referrers agree to comply with all applicable law including, but not limited to, “Can Spam” laws, including mass emailing, texting or messaging unknown individuals or telephone numbers using automated systems or bots through any channel to distribute your referral code. Referrers are prohibited from paying to advertise their referral codes. Any violation of this provision is expressly prohibited and will be grounds for immediate termination of Referrer’s account.
Customers who have signed up using a valid referral code will also receive credit in the form of a Referral Reward in the amount(s) indicated in the referral invitation and/or accompanying promotional materials. Customers must apply a valid and active referral code during checkout to qualify for a Referral Reward. Referral codes may not be transferred to another person, exchanged for cash, or combined with other Flexcar referral programs or incentives. A referral code may only be used one time by a Customer on www.Flexcar.com in conjunction with the booking of an eligible Flexcar. Existing Flexcar customers are not eligible to receive or utilize referral codes intended for Customers.
Flexcar reserves the right to any remedy, including cancellation of your account or reservations, if fraud, tampering, violations of these terms or Flexcar’s Terms of Service or Payments Terms of Service, or technical errors are suspected. Void where prohibited. If your reservation later qualifies for a refund, the maximum refund you may receive is the amount you actually paid. Under no circumstances will a refund be made for the cash value or cash equivalent of a previously applied Referral Reward.
A Customer may only redeem one referral code for Referral Rewards. If a Customer receives referral codes from multiple Referrers, only the Referrer associated with the referral code actually used by the Customer will receive a Referral Reward.
The Program may not be combined with other Flexcar referral programs or incentives.
If any provision in these terms are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.
Termination and Changes
Flexcar may suspend or terminate the Program or a user’s ability to participate in the Program at any time for any reason without prior notification.
We reserve the right to suspend accounts or remove Referral Rewards if we detect any activity that we believe is abusive, fraudulent, or in violation of the Flexcar Terms of Service or Payments Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion.
The scope, variety, and type of services and products available by redeeming Referral Rewards may change at any time.
Updates to the Terms
Flexcar can update, modify, alter or amend these terms at any time without prior notice. If we modify these terms, we will post the modification on the Flexcar.com website, which are effective upon posting. Continued participation in the Program after any modification shall constitute consent to such modification.
Standard text messaging rates or charges from the wireless carrier for both the Referrer and Customer may apply. Any costs related to sending or receiving messages are the responsibility of the Referrer or Customer respectively.
